If you're looking for a points card, a punch card, a "buy ten get one free" programme, or a members-only discount scheme for your vape shop — the answer from Canadian law is no. The Tobacco and Vaping Products Act (TVPA) prohibits a wide range of promotional incentives for vaping products, including gifts, bonuses, premiums, cash rebates, contest entries, and other forms of consideration offered at the point of purchase. Most of the loyalty mechanics that work in other retail categories are explicitly off the table.
That doesn't mean customer retention is impossible — it means the tools look different. This guide covers exactly what the TVPA prohibits, where the legal grey areas are, and what retention strategies actually work within the law.
Part 1: What the TVPA Prohibits
Section 30.6 of the TVPA is the relevant provision. It prohibits manufacturers and retailers from offering any form of promotional consideration for the purchase of a vaping product — with heightened restrictions in places accessible to young persons.
| Promotional format | TVPA status |
|---|---|
| Points-based loyalty card / app | ❌ Prohibited — constitutes "consideration for the purchase" of a vaping product |
| Punch card ("buy 10 get 1 free") | ❌ Prohibited — bonus product for purchase |
| Gift with purchase | ❌ Prohibited — "gift to a purchaser or a third party" |
| Cash rebate or discount voucher on vaping products | ❌ Prohibited — "cash rebate" |
| Contest or draw entry for purchasing | ❌ Prohibited — "right to participate in a game, draw, lottery or contest" |
| Branded lifestyle merchandise (lighters, bags, clothing) | ❌ Prohibited if it associates vaping with glamour, excitement, or risk-taking, or appeals to young persons |
| Referral bonuses tied to vape purchases | ❌ Prohibited — consideration offered for purchase |
The prohibition applies to the purchase of vaping products specifically
The TVPA's s.30.6 restrictions apply to incentives offered in exchange for purchasing a vaping product. A loyalty programme that rewards purchases of non-vaping items sold in the same store — accessories, merchandise, non-nicotine products — is a different legal question and outside the scope of this guide. If your shop sells a meaningful mix of non-regulated products, consult legal counsel on how a mixed-basket programme would be structured. Don't assume a blanket shop-wide programme is automatically compliant.
Part 2: What the Law Does Not Prohibit
The TVPA's promotional restrictions are specific to incentives tied to vaping product purchases. Several retention activities fall outside that scope.
| Activity | TVPA status | Notes |
|---|---|---|
| Email communication to age-verified adult customers | ✅ Permitted (with VPPR compliance) | Operational content — new stock arrivals, regulatory updates, hours — is not a promotional incentive for purchase |
| Excellent in-store service and staff expertise | ✅ Permitted | The most durable retention driver in a restricted-marketing category |
| Consistent, compliant product availability | ✅ Permitted | Customers return for reliability; out-of-stocks drive switching |
| In-store events (age-verified, adult-only premises) | ⚠️ Proceed carefully | No promotional incentive attached to purchase; VPPR advertising rules apply to any associated promotion |
| Informational content (compliance guides, product education) | ✅ Permitted | Not a promotional incentive — purely informational |
Part 3: What Actually Retains Vape Customers
The irony of the TVPA's loyalty restrictions is that the tactics they ban — points, punches, discounts — are also among the least effective retention tools in a category where product quality and consistent availability drive repeat purchase more than reward mechanics.
Product consistency is the primary driver. Vape customers are brand and flavour loyal before they are store loyal. A retailer who reliably stocks the SKUs customers want — correct format, correct nicotine level, legitimately stamped — wins repeat visits without any programme. A retailer who substitutes, runs out, or pivots assortment unpredictably loses customers to whoever has what they want in stock today. Our guide to evaluating new vape brands before stocking walks through the due-diligence questions worth asking at each reorder.
Staff knowledge converts and retains. In a category where customers are making decisions about nicotine delivery format, device type, and flavour preference, a staff member who can answer questions accurately and help with a switch (e.g., from a higher-nicotine device to a lower one, or from disposables to a pod system) builds the kind of relationship that survives a competitor opening nearby. This isn't soft advice — in a category where advertising is restricted, the in-store conversation is one of the few promotional channels that actually works.
Operational reliability compounds over time. Hours that don't change unexpectedly, phone inquiries that get answered, online stock information that's accurate — these are table stakes elsewhere and competitive advantages in a category where many operators are still running loose operations. Customers who can depend on a shop keep coming back; ones who get burned by a wasted trip go looking for alternatives.
Part 4: Email — The One Scalable Compliant Channel
Email to a list of age-verified adult customers is the closest legal equivalent to a loyalty programme for Canadian vape retailers. It's not a promotional incentive — it's communication — and it's VPPR-compliant when the content is operational rather than lifestyle promotional.
| Email content type | VPPR compliance | Example |
|---|---|---|
| New product arrivals — factual, no lifestyle framing | ✅ Compliant | "We've received the new Lost Mary OS50000 in two additional flavours — now in stock." |
| Regulatory or compliance updates relevant to customers | ✅ Compliant | Excise stamp changes, provincial rule updates |
| Stock alerts for specific SKUs | ✅ Compliant | "Lost Mary OS50000 is now in stock in two additional flavours." |
| Lifestyle imagery, flavour excitement, social identity framing | ❌ Not compliant | "Summer flavours to match your vibe" — lifestyle advertising, prohibited under VPPR |
| Discount or promotional offer on vaping products | ❌ Not compliant | "10% off your next purchase" — promotional incentive prohibited under TVPA s.30.6 |
| Testimonials or endorsements | ❌ Not compliant | "Our customers say this is the best flavour" — testimonials prohibited under VPPR |
The list itself is the asset. An age-verified email list of your actual customers — built through in-store sign-up at the point of sale — is something no competitor can replicate and no platform can deplatform. It's slower to build than a social following, and the content has to be genuinely useful rather than promotional, but it's the most durable direct channel a Canadian vape retailer has access to. For retailers also running an online store, our Shopify vape compliance guide covers how age verification at checkout intersects with the same VPPR rules that govern your emails.
Part 5: A Realistic Retention Calendar
| Activity | Frequency | TVPA/VPPR status |
|---|---|---|
| Email to verified adult list — new arrivals, stock updates | Monthly or as stock warrants | ✅ Compliant |
| Staff training on current assortment and product questions | Quarterly or with each major reorder | ✅ Compliant |
| Assortment review — are your top SKUs reliably in stock? | Monthly | ✅ Compliant |
| GBP updates — hours, new products listed factually | As changes occur | ✅ Compliant — see our GBP guide |
| Any points, punch card, gift, discount, or contest mechanic | Never | ❌ Prohibited under TVPA s.30.6 |
The retailers who retain customers best in this category aren't the ones running the most sophisticated loyalty scheme — they're the ones who are consistent, knowledgeable, and reliable enough that switching feels like more effort than it's worth. In a heavily restricted marketing environment, operational excellence is the retention strategy. Everything else is secondary.
Consistent, properly stamped product availability is part of that equation. If you want to build a wholesale relationship that supports a reliable assortment, start here.
